By accessing or using drsmartiq.com ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

DrSmartIQ provides an online cognitive assessment test designed to estimate IQ-like cognitive ability across multiple domains (pattern recognition, verbal reasoning, spatial reasoning, logical reasoning, and mathematical ability). Upon completion, users may purchase a detailed personalised report.

Important disclaimer: Our test is an entertainment and self-assessment tool. Results are not a certified clinical IQ measurement and should not be used as a substitute for professional psychological evaluation. Scores are norm-referenced estimates only.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you may only use the Service with the consent of a parent or legal guardian.

4. Accounts

• You may create an account to save your results and access them later.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating an account.
• We reserve the right to terminate accounts that violate these Terms.

5. Purchases and Payment

• The detailed results report is available for a one-time payment displayed at checkout.
• All payments are processed securely by Stripe. We do not store your card details.
• Prices are displayed in USD and are inclusive of any applicable taxes unless stated otherwise.
• Your report is delivered immediately upon successful payment confirmation.
• Purchases are tied to a specific test session and are non-transferable.

6. Intellectual Property

All content on the Service — including but not limited to test questions, scoring algorithms, report content, design, graphics, and text — is the exclusive property of DrSmartIQ and is protected by copyright and intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any portion of the Service or its content without our express written permission.

7. Prohibited Conduct

You agree not to:

• Use automated tools, bots, or scripts to take the test or access the Service.
• Attempt to reverse engineer, decompile, or extract our test questions or algorithms.
• Share, resell, or redistribute your purchased report to third parties for commercial gain.
• Attempt to circumvent the payment system or access paid content without purchase.
• Impersonate another person or misrepresent your identity.
• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Interfere with or disrupt the integrity or performance of the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY RESULTS OR CONTENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRSMARTIQ AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the website. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
